How long does a sender have to hold opt-out email addresses?

Our database has opt-outs for the last five years. How long do we have to keep them?
We have a mailing database of 87K names for a weekly newsletter for the last 9 years; the opt-outs are about 2K, but many are over 5 years old. Os ot ;aw pr opinion that these must be held forever?

As long as you are “in business,” you are going to be required to keep the list of people whom are not interested in your services active and up-to-date.

P.S.: Don’t be a class-1 piece of garbage and sell your opt-out list to another outfit. You can even have a more favourable response (i.e.: they may actually come back at a later date) from the people that opt-out (and a fair number that opt-in) if they know you don’t sell your mailing lists.
